Employment and labour

The Labour Law governs the relationship between employee and employer: from the employment contract, wages and working hours to leave, termination and end-of-service entitlements. We advise and represent both employees and employers in the private sector in the Sultanate of Oman.

What this area covers

  • Claims for unpaid wages, allowances and end-of-service entitlements.
  • Unfair dismissal and unlawful termination claims.
  • Drafting and reviewing employment contracts and employers’ work regulations.
  • Disputes over leave and overtime.
  • Claims relating to work injuries.
  • Disciplinary procedures and internal investigations.

How a labour dispute proceeds

A labour dispute usually starts with a complaint to the Ministry of Labour, which tries to settle it amicably. If the complaint is not settled, it is referred to the competent court. We help the client draft the complaint or the response, attend the settlement sessions, and then handle the case if it reaches court.

We calculate the amounts claimed with the client on the basis of the contract, payslips and the law, so the claim is realistic and supported by documents.

What makes a labour claim strong

A labour claim depends on what can be proved: the type and duration of the contract, the actual agreed wage, the reason for and manner of termination, and the entitlements already paid. We review these elements in the first consultation and explain to the employee or employer the amounts their position rests on, and the points the other side may contest, before the complaint is filed or answered.

For employers

Labour disputes become much less frequent when contracts and internal regulations are clear and compliant with the law. We review employers’ contract templates and their warning and dismissal procedures before they are applied, to reduce the risk of disputes and claims later.

Documents that help us assess your matter

  • The employment contract and any annexes or renewals.
  • Payslips or bank transfers of salary.
  • Warning, termination or resignation letters.
  • Correspondence between employee and employer.
  • Evidence of working hours or leave due.

When to seek advice

Labour claims are subject to legal time limits, so do not delay seeking advice after employment ends or when you receive a termination letter.
