Family and personal status
Family cases are among the most sensitive, because they directly affect family relationships and children. We handle them calmly and confidentially, explain rights and obligations under the Personal Status Law, and look for solutions that protect the children’s interests and the family’s stability wherever possible.
What this area covers
- Marriage contracts and special conditions in them.
- Divorce, khula and judicial separation.
- Maintenance for wife, children and relatives.
- Custody, visitation and arrangements for seeing the children.
- Division of estates, determination of heirs and wills.
- Guardianship over minors’ property.
How we work on family matters
We start by listening to the details and understanding what the client actually wants, then explain the available options: from an amicable agreement that is properly documented, to going to court when agreement is not possible. A written agreement between the parties, especially on maintenance, custody and visitation, is often faster and less harmful to the children than a long dispute.
In inheritance matters, we help heirs identify the estate and the shares, and handle the transfer and division of property, either by agreement between the heirs or through the court.
The children come first
In custody, visitation and maintenance cases, the court looks at the child’s interest before anything else. We help clients propose practical, realistic arrangements for the children’s housing, schooling and visiting times, rather than focusing only on the disagreement between the parents. When the parties agree, we draft the agreement clearly, setting out amounts, times and responsibilities, so the disagreement does not return a few months later.
Documents that help us assess your matter
- Identity cards of the parties.
- The marriage contract.
- Children’s birth certificates.
- Evidence of income or expenses in maintenance claims.
- Death certificate, heirs’ certificate and title deeds in estate matters.
After the judgment
A judgment on maintenance, custody or visitation is not always the end of the matter. The client may need to follow up its enforcement, or ask for it to be varied if circumstances change, such as a change in the paying party’s income or the children moving to another city. We explain what can be requested in these situations and how.
